What is the difference between a published and unpublished patent application?
A patent application is typically published 18 months after submission to a patent office. This publication does not mean that a patent is granted or all claims will be approved. It simply places the patent application in the public domain while being examined. During the first 18 months, the filed patent application is kept confidential and not available to the public.

What is a provisional patent and how does it differ from a regular patent?
Under United States patent law, a provisional patent application is a type of national patent application filed with the United States Patent and Trademark Office (USPTO), but which is not examined and does not mature into an issued patent unless further steps are taken by the applicant. A provisional patent application can be characterized as a place holder for a conventional patent application and is not published. Colgate does not review ideas based on a provisional patent application.

Will Colgate pay for any of my patent and/or patent application fees?
No.

Why won't Colgate accept ideas that do not have patents or published patent applications?
Colgate relies on U.S. patent law to protect your rights, as well as Colgate's. As a leader in its field, Colgate is often working on many ideas internally, and if a similar idea is submitted, the patent process helps clarify ownership and priority.

How long does it take for a patent application to be published? How will I know it's been published?
Unless examined and issued as a patent earlier, it will publish 18 months after submission. All published U.S. patent applications can be found in the USPTO website (www.uspto.gov).

How long does it take for an idea to come to market?
Many factors influence the time it takes to commercialize a product. It is not uncommon to take three to five years or more.

What types of ideas are NOT accepted for review? Why not?
We do not accept market or advertising ideas, because we employ experts in these fields specifically to generate and execute such ideas. Of course, product ideas without a patent or published application cannot be accepted for review.

Terms and Conditions for Idea Submission and Review

By submitting Ideas (as defined below) to this website ("Site"), you agree to all terms, conditions, and notices contained or referenced in this Submission Agreement ("Agreement"), the Legal Policies and Privacy Policies of this Site. If you do not agree with the terms, conditions and notices of this Agreement, the Legal Policies and the Privacy Policies (collectively, "Terms"), please do not submit Ideas to the Site. In the event of a conflict between the terms of the Legal Policies, Privacy Policies and these Terms and Conditions, the terms of these Terms and Conditions will apply.

Colgate-Palmolive Company, including any of its subsidiaries, (referred to as "CP," "we," "us," or "our") reserves the right at its discretion to change, modify, add or remove portions of the Terms at any time. Please check the Terms periodically for changes. Your continued use of the Site following the posting of changes to the Terms will mean you accept those changes.

As used in this Agreement, the term "Ideas" means ideas which are patented or the subject of a pending published patent application that you submit or otherwise provide to us. Your submission of an Idea is subject to the following terms and conditions:

  1. We will consider an Idea that is patented or the subject of a pending published patent application only if you agree to rely exclusively on your rights under the Patent Statutes. Only such Ideas will be accepted for review. You understand that you should file for your Patent Rights before disclosing your Idea to anyone (including CP or any other party) on a non-confidential basis or you may risk losing the ability to protect your ideas with Patent Rights according to applicable law.
  2. Only Ideas submitted in writing, which includes Ideas submitted through this Site, can be considered. We shall not be under any obligation with respect to Ideas that are offered in any other manner. Please retain a duplicate of all material you submit, as we are under no obligation to return any material you may submit now or at any other time. It is our policy to keep a complete record of all submissions. Thus, you should not furnish us with anything you expect to be returned.
  3. We will not accept any Idea in confidence, or on the basis that a confidential relationship is created or exists between us, or under a guarantee that we shall maintain the Idea in secret, or on the basis that an agreement exists, either implied or explicit, that we will compensate you for our evaluation and/or use of your Idea. You are also free to disclose your Ideas on any basis to any other party during the course of our evaluation.
  4. Acceptance of Ideas shall not constitute a waiver by us of any rights we had or may have with respect to ideas or products or inventions or information that are proprietary to us, developed or created by us or owned by us whether such rights arise out of an employment relationship or any other type of relationship or contract or communication.
  5. We will be the sole judge of our interest in your Idea after evaluation.
  6. We, in our sole discretion, may decide whether or not (1) to contact you regarding the Idea submitted, (2) to engage in further discussions regarding the Idea submitted, and (3) to accept the Idea submitted and to enter into an agreement related thereto.
  7. If we decide not to use your Idea, we are not obligated to give you any reason for this decision or reveal past or present company ideas related to your submitted Idea.
  8. Any discussion we may have relating to compensation for your Idea or any offers we may make for any such compensation shall not bind either of us unless both of us enter into a written agreement. Such agreement will define all rights and obligations that either of us may have. No discussion or offer shall be deemed or inferred to be an admission of novelty, priority, or originality of your Idea.
  9. You, the submitter, represent and warrant that:
    1. Your disclosure of your Idea and any other information you submit to us is not in violation of any commitment or obligation to any former or present employer, or any other party or organization;
    2. You have the full and unconditional right to disclose your Idea and any other information you submit to us;
    3. You own the entire right, title, and interest in and to the Idea(s) and any other information that you are submitting;
    4. You are at least 18 years old.
  10. In consideration of Colgate-Palmolive evaluating your Idea, you release Colgate-Palmolive from any and all liability with respect to your Idea except for infringement of any patent that you now own or any patent that is granted on the patent application identified by you in this submission. Of course, you understand that Colgate-Palmolive reserves the right to assert any and all defenses with respect to any such charge of patent infringement.
  11. All of the above conditions shall also apply to all supplemental disclosures made by you, or on your behalf to us.
